3 injured in I-5 car-truck accident near Centralia

Three people were taken to a Centralia hospital with injuries after a crash on Interstate 5 that backed up traffic Wednesday morning for about six hour hours.

The Washington State Patrol says it happened about 3:30 a.m. in south Thurston County when a semi-truck hit two cars that had slowed to merge around a construction project.

The crash closed all southbound lanes and one northbound lane. Southbound traffic was detoured.

The Transportation Department reported backups of six miles southbound and seven miles northbound before lanes were reopened about 9:30 a.m.

CONSTRUCTION SITE INJURIES AND JOB SITE ACCIDENTS

In Washington, under the Washington Industrial Safety Act (WISHA), the general contractor on any work site has a nondelegable duty to enforce all safety regulations for all employees on site, not just the employees of the general contractor. This duty runs from all upper tier subcontractors to all lower tier subcontractors which the sub may hire on the job site.  This nondelegable duty to enforce all safety regulations on all work sites applies not just to general contractors but to owners, developers and those with supervisory authority in the work place. All employers are obligated to provide a reasonably safe work place for its employees and those with whom it contracts with to furnish labor and materials for it.

If a worker is injured in the work place, he may file a worker’s compensation claim.  An injured worker not only has a right to file a worker’s compensation, e.g. a Labor and Industries claim, but may also have a viable “third party claim” to recover damages against the contractor, subcontractor or any other independent trade which was negligent.  This would be a claim against any negligent company or an employee of another company on a job site which caused the worker’s injury.  The injured worker may file a third party claim against the employer of the negligent worker and arguably claim that the employer or its employee failed to enforce or follow certain WISHA or OSHA regulations.

Remember, an injured worker may not bring a third party claim against his or her own employer. An employer is immune from suit under Title 51.  However, it is very important to understand that an injured worker may recover general damages on a third party claim in addition to a recovery of his or her full worker’s compensation first party benefits.

Renton Car Accident Shuts Down SR 167

RENTON, Wash. – Northbound State Route 167 was shut down for 45 minutes during the Friday afternoon rush hour after a five car accident.

It happened at 4 p.m. near the 180th Street Exit. The cause of the crash was not immediately known.

Video from a Washington State Department of Transportation camera shows the jersey barrier separating the northbound and southbound lanes moved as a result of the crash.

The northbound backup was several miles. Southbound traffic was also affected as drivers slow down to see what happened.

It’s not immediately known if anyone was hurt.

Elderly woman hit by bicyclist on Renton trail dies of injuries

RENTON, Wash. – An elderly Renton woman who was hit by a bicyclist on the Cedar River Trail on Sunday has died.

Police say the 83-year-old woman was walking eastbound on the Cedar River Trail about a quarter mile east of I-405 at about 4:45  p.m. and two bicycle riders were also travelling eastbound behind her and off to her left side.

Police say as the bicycles began to pass the woman, she stepped in front of them and was struck by one of the bicycles.

The cyclist and the woman both fell down.  The 57-year-old male bicycle rider was treated at the scene for minor injuries.

The pedestrian was taken to Harborview Medical Center in critical condition with head injuries. She died on Monday.

The Renton Police Department Traffic Division is investigating.

Ferry worker slightly injured by car during offloading

Washington State Ferries canceled a sailing from Edmonds Wednesday after a car leaving the ferry Puyallup grazed a ferry worker.

According to ferry security, the worker received minor injuries when the car struck him. He was taken to a hospital for evaluation, according to Washington State Ferries.

In addition, the car also struck an inner wall of the Puyallup car deck, resulting in some delay in offloading the vessel. Arrangements were being made for the car to be towed off the boat, resulting in the canceled voyage.

Man Crashes into Renton Mobile Home, Rescued by Fire Department

A Seattle man in his 50s was extricated from his vehicle after it crashed into a parked mobile home on Rainier Avenue South early Friday afternoon, according to Fire District 20.

The man received minor injuries and was taken to a local trauma center for evaluation, according to Dave Nelson, a spokesman for the fire district, which covers Skyway and West Hill.

The incident occurred at about 1 p.m. in the 11400 block of Rainier Avenue South. The King County Sheriff’s Office is investigating.

The man was extricated with assistance from Renton Fire and Emergency Services. No one was inside the mobile home, which was destroyed.

While this story shows no sign of a potential Renton personal injury claim it demonstrates how one can arise.
